Aren't those who promoted this Death Pathway equally culpable, equally liable?

This has to be the ultimate in conflict of interests when those paid by the public, working for the public and, therefore, with a duty to the public commit grave error against the public then use public funds (charge the public) in order to defend such charges of grave error against them and pay with those funds taken from the public for lawyers to refute these charges the public have made against them.

In June, the NHS Litigation Authority, working with the Department of Health, appointed a new £400m legal advice panel of solicitors to provide legal services to 15 DoH organisations over the next four years.

Fourteen firms of solicitors will serve on the new legal advice panel and will provide legal services in all three areas: Clinical liability, non-clinical liability, and regulatory, including clinical and other negligence and specialist healthcare, health and disciplinary. The contract is for four years. 

Organisations previously procured their own legal advice. The 15 organisations that will benefit are:
Care Quality Commission, Health Education England, Health Research Authority, Health and Social Care Information Centre, Human Fertilisation and Embryology Authority, Human Tissue Authority, Medicines and Healthcare Products Regulatory Agency, Monitor, NHS Blood and Transplant, NHS Commissioning Board, The National Institute for Health and Care Excellence, NHS Litigation Authority, NHS Trust Development Authority, Professional Standards Authority, Public Health England.
The tender was initially due to take place in December. A supplier day was also delayed and took place on 22 February.

·         Healthcare Professional Alert Notices - new arrangements from 1 April 2013

​NHS England has written to NHS Trust Medical Directors and Area Team Medical Directors setting out interim arrangements for issuing Healthcare Professional Alert Notices.
In the letter, the Secretary of State has directed the National Health Service Litigation Authority to operate the Healthcare Professional Alert Notices (HPAN) system from 1 April 2013.

NHS organisations who wish to request the issue of an Alert Notice should notify the National Clinical Assessment Service (NCAS), part of the NHS LA, at hpan@ncas.nhs.uk or telephone 020 7972 2999.


·         New CNST Scheme Rules

New CNST scheme rules came into effect on 1 April 2013.  These incorporate a number of changes for the benefit of members, including discretionary cover for Inquest costs and an expanded section on run-off cover.

The National Clinical Assessment Service (NCAS) is now an operating division of the NHS Litigation Authority (NHS LA).
NCAS joins the NHS LA from the National Institute for Health and Clinical Excellence (NICE) where it has been hosted from April 2012.
Catherine Dixon, Chief Executive of NHS LA, said: “We are looking forward to working with NCAS. The NHS LA and NCAS have a shared purpose to help improve patient safety in the NHS and in healthcare more broadly. We believe that our complementary expertise will benefit the NHS.”

They found that money soon enough, but when it comes to caring for the sick, the frail and the vulnerable, they're a bit slow off the mark...

Unless it's to put them on palliative care, of course!

And the truth gets buried along with their mistakes.

This has got to be something out of some political conspiracy thriller...
